Joe Manchin Supports Keeping Filibuster, Killing Any Democrat Bill to Legalize Abortions Up to Birth

In the aftermath of yesterday’s leak of a potential Supreme Court decision to overturn Roe, Senator Joe Manchin says he will not vote to end the filibuster. That means any Democrat bill to codify Roe and legalize abortions up to birth is dead.

Just one day removed from the leak, top Democrats are planning a vote on a bill that would codify Roe — which means it would legalize abortions up to birth and overturn pro-life laws nationwide. To get such a bill through the Senate, Democrats have to either overcome or vote to end the filibuster. A rules change could require 50 votes (with Kamala Harris voting to break the tie) but they won’t get it thanks to the West Virginia lawmaker.

Senate Majority Leader Chuck Schumer has pledged to bring legislation codifying Roe v. Wade to the floor of the upper chamber of Congress in the wake of the leak of a draft opinion in Dobbs v. Jackson Women’s Health Organization, but will be unable to do so if Manchin is a no go.

“The filibuster is a protection of democracy,” Manchin told reporters on Tuesday.

Meanwhile, Kyrsten Sinema says she is a no vote on ending the filibuster — definitely killing any Democrat bill to legalize abortions up to birth.

Sinema also defended the filibuster on Tuesday, saying that “protections in the Senate safeguarding against the erosion of women’s access to health care have been used half-a-dozen times in the past ten years, and are more important now than ever.”

In February, Senate Republicans, with the help of Democrat Senator Joe Manchin, voted to defeat a Democrat bill that would overturn every pro-life law in America and legalize abortions up to birth.

As LifeNews reported, in a monumental decision that could finally end an era of abortion on demand and 63 million babies killed in abortions, the Supreme Court has reportedly issued a decision overturning Roe v. Wade. This is according to a release of a draft of the decision.

“Roe was egregiously wrong from the start,” Justice Samuel Alito wrote in the draft opinion of the court dated February 10.

Chief Justice John Roberts has issued a statement confirming the leaked draft of a Supreme Court decision overturning Roe is genuine and he says the nation’s highest court will launch an internal investigation about the leak.

There was speculation previously that Roberts was not writing the case and concern that he could try to influence the other justices to oppose overturning Roe. Since he confirmed the draft is genuine, the former appears true.

According to Politico the decision is not final and could change but the leaked draft of the opinion has four justices — Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett — joined Alito while three — Stephen Breyer, Sonia Sotomayor and Elena Kagan — dissented.

“We hold that Roe and Casey must be overruled,” the opinion reportedly continued. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

Roberts has yet to cast his vote and it is unknown which side he will vote with, Politico reported.
