Pro-Life Advocates Condemn Supreme Court Leak as Leftist Effort to Intimidate SCOTUS to Keep Roe

Leading pro-life advocates and pro-life Republican senators condemned the leak of a draft of a decision to end Roe v. Wade as an attempt by leftists to intimate the Supreme Court into keeping the radical pro-abortion decision in place.

As LifeNews reported, Supreme Court has reportedly issued a decision overturning Roe v. Wade. This is according to a release of a draft of the decision.

“Roe was egregiously wrong from the start,” Justice Samuel Alito wrote in the draft opinion of the court dated February 10, according to Politico.

First, Supreme Court observers are demanding an investigation into who leaked the draft.

Josh Blackman, a constitutional law professor at the South Texas College of Law Houston, said Chief Justice Roberts “has an absolute obligation to conduct a thorough and transparent investigation.”

“And at the end of that investigation, Roberts must publicly identify the persons who are responsible for this leak — that includes Justices and clerks,” Blackman wrote at the libertarian web site Reason.

Mike Davis, a former law clerk to Justice Neil M. Gorsuch, tweeted that “this leak of a pending case puts the lives of justices in danger.”

Next, pro-life Republican senators are calling the leak a liberal intimidation effort to try to get the high court to keep Roe in place by attempting to prematurely spark a national backlash to the idea.

“The left continues its assault on the Supreme Court with an unprecedented breach of confidentiality, clearly meant to intimidate,” tweeted pro-life Sen ator Josh Hawley. “The Justices mustn’t give in to this attempt to corrupt the process. Stay strong.”

Senator Marco Rubio added, “The next time you hear the far left preaching about how they are fighting to preserve our Republic’s institutions & norms remember how they leaked a Supreme Court opinion in an attempt to intimidate the justices on abortion.”

In response to the attempted intimidation, some SCOTUS observers are saying the Supreme Court should release the decision immediately to subvert this leftist attempt to intimidate the Court and incite a mob.

“If this story is true, the Court should issue its opinion right away. Otherwise the disgraceful leak wins. I would say that if my side lost. If we lose the integrity of the Court’s process, we lose the Court. That should be intolerable to all of us who live [in] the country,” former federal prosecutor Andrew McCarthy tweeted.

Mr. Davis, the former Gorsuch clerk, issued a concurring tweet.

“The Court must issue its decision immediately,” he wrote.

According to Politico the decision is not final and could change but the leaked draft of the opinion has four justices — Clarence Thomas, Neil Gorsuch, Brett Kavanaugh and Amy Coney Barrett — joined Alito while three — Stephen Breyer, Sonia Sotomayor and Elena Kagan — dissented.

“We hold that Roe and Casey must be overruled,” the opinion reportedly continued. “It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives.”

Chief Justice John Roberts has yet to cast his vote and it is unknown which side he will vote with, Politico reported.

“It’s impossible to overstate the earthquake this will cause inside the Court, in terms of the destruction of trust among the Justices and staff,” SCOTUSblog tweeted Monday night. “This leak is the gravest, most unforgivable sin.”

No draft opinion of the court in modern history has ever been leaked in this manner, Politico reported. It has already been derided as an effort to bully the Supreme Corut into keeping Roe in place and Jonathan Turley called “one of the greatest breaches of security in the history of the Court.”

Leading pro-life groups weighed in on the news of the leaked draft saying they hope eventually the accuracy of the Supreme Court overturning Roe will be confirmed.

“We don’t know whether rumors of the end of Roe are accurate yet, but we know that ending Roe is the right decision, returning the issue to “We The People” from a few judges with an agenda,” said Kristan Hawkins of Students for Life of America. “You won’t find “abortion” written in invisible ink in the Constitution undiscovered until 7 men saw it in 1973. Ending preborn human life is and has always been a judicial error.”

Ohio Right to Life Michael Gonidakis, an attorney, told LifeNews he is “cautiously optimistic that the the Supreme Court will rule correctly and overturn the most reckless decision in our Nation’s history. ”

“It is hard to articulate though just how momentous this could be. For nearly 50 years our country has allowed over 62 million children to be killed by abortion. Now is our time to stop this. It is time to rebuild the culture of life. It is time for Roe to go,” he said.
