Colorado Democrats’ Bill Would Legalize Killing Babies in Abortions Up to Birth

Colorado Democrats introduced a radical pro-abortion bill Thursday that would keep abortions up to birth legal and ban lawmakers from granting any rights to unborn babies in the state.

The Denver Post reports state House Bill 1279 would make abortion a “fundamental right” under state law. A majority of Democrats in both chambers already have co-sponsored it, so it appears likely to pass.

However, pro-life state Rep. Dave Williams, R-Colorado Springs, told the Post that Republican lawmakers will “fight against it and oppose it with everything we have.”

“While abortion has been allowed throughout the country since Roe v. Wade, you really haven’t seen this type of effort, even from Democrats, to declaratively say in state statute that unborn children are not human,” Williams said.

Colorado already allows unborn babies to be aborted for any reason up to birth, and it is a destination state for late-term abortions. But the bill would make it even more difficult to pass any limits on abortion by codifying the “right” to abortions in state law.

Democrats crafted the bill in response to the likelihood that the U.S. Supreme Court will overturn Roe v. Wade later this year and allow states to protect unborn babies from abortion again. They also are angry that Texas has been allowed to enforce its heartbeat law, which protects unborn babies from abortions once their heartbeats are detectable and already has saved thousands of lives.

“… It really came to a crisis point where we were pretty clearly seeing the very disturbing vision of what a post-Roe world would look like,” said state Rep. Meg Froelich, D-Greenwood Village, the lead sponsor of the bill.

KDVR-TV reports the bill would prohibit state and local authorities from “denying, restricting, interfering with, or discriminating against an individual’s fundamental right to use or refuse contraception or to continue a pregnancy and give birth or to have an abortion in the regulation or provision of benefits, services, information, or facilities.”

It also would explicitly deny all rights, including the right to life, to any “fertilized egg, embryo or fetus” under state law.

Pro-abortion groups supporting the bill include the Latina Opportunity and Reproductive Rights and Cobalt.

Colorado is very liberal politically, and pro-life advocates have had a difficult time passing any pro-life laws there. Even fetal homicide laws to punish criminals who kill unborn babies in situations unrelated to abortion have been rejected repeatedly by the state legislature.

Colorado is one of the few states with no limits on abortions, and abortionists there openly advertise abortions in the third trimester.

In 2020, state voters rejected a ballot measure that would have protected viable, pain-capable unborn babies by banning late-term abortions after 22 weeks of pregnancy.
