Court Okays Killing 26-Week-Old Viable Unborn Baby in Abortion

More and more late-term unborn babies in India are becoming abortion victims because of the courts.

Though India prohibits abortions after 20 weeks of pregnancy, courts have been granting numerous exceptions to the law in recent years for victims of rape and unborn babies with disabilities.

In the newest case, the Delhi High Court gave a 16-year-old girl permission to abort her unborn baby at 26 weeks of pregnancy despite a medical board’s warnings about complication risks, News 18 reports.

The girl is a victim of rape, and her family only recently found out that she was pregnant, according to the report.

During the hearing Monday, the court said the victim and her mother insisted on the abortion despite the medical board’s recommendations. The medical board not only warned that the girl’s life could be at risk if she has the late-term abortion, but they also said her baby could be born alive, the report states.

However, lawyer for the family Vrinda Grover said the girl could suffer more mental trauma if she does not have an abortion.

The Delhi court agreed that the abortion may take place. The judges also ordered that the baby’s body be preserved as evidence for the rape charges against the girl’s abuser, according to the report.

Abortions involve two lives, not just one, and late-term abortions can be deadly to mothers as well as their unborn babies. Whether a woman gives birth or aborts her unborn baby, she still has to go through labor and delivery. The main difference is that in a late-term abortion, the unborn baby is already dead.

A third-trimester abortion typically involves injecting a poisonous potassium chloride solution through the woman’s stomach into the baby’s heart – causing excruciating pain to the baby as the poison stops his/her heart. A few days later, labor is induced and the woman delivers her dead baby’s body.

Late-term abortions also are dangerous for mothers. Even abortion advocacy groups admit that the risks of abortion increase greatly later in pregnancy, and women sometimes die along with their unborn babies.

The Asian country has some of the highest abortion numbers in the world. Approximately 15.6 million unborn babies were aborted in the country in 2015, according to the Guttmacher Institute.
