Trump Ends Liberal Domination of 9th Circuit Appeals Court as It Upholds Defunding Planned Parenthood

There was a time not that long ago when the 9th Circuit Appeals Court was the most liberal federal appellate court in the nation. But then President Donald Trump got a hold of it.

Trump has ushered in the end of an era — no more will liberals dominate the 9th Circuit Court of Appeals and use the federal appellate court as a rubber stamp for defeating pro-life legislation and pushing abortion on demand.

Last Fall, the U.S. Senate voted to confirm Deputy Assistant Attorney General Lawrence VanDyke to serve on the 9th U.S. Circuit Court of Appeals. President Trump nominated VanDyke in September.

Lawrence VanDyke graduated from Harvard Law School with high honors. Prior to his nomination to the 9th Circuit, VanDyke served as deputy assistant attorney general at the Department of Justice. He has extensive experience serving as solicitor general in both Montana and Nevada, as well as in private practice.

VanDyke’s nomination was groundbreaking because it officially flipped the appeals court to a conservative majority. And that sea change was not lost on pro-life leaders.

He will be an outstanding addition to the 9th Circuit,” said SBA List President Marjorie Dannenfelser. “His distinguished record makes him highly qualified to serve on the federal bench. Father Frank Pavone of Priests for Life told that President Trump has been sucessful in remaking the federal appeals court. With the Senate’s confirmation this week of Patrick Bumatay and Lawrence VanDyke for the Ninth Circuit, the president has now seated more than 170 federal judges, including his two Supreme Court nominees.

“With the confirmation this week of two judges for the Ninth Circuit Court of Appeals, President Trump continues to make good on his promise to end liberal judicial activism on the federal bench. With 13 of 29 judges on the court appointed by Republican presidents, the liberal rubber stamp of the Ninth Circuit has been stilled.”

Father Pavone also noted that President Trump has flipped three courts – the Second, Third and 11th Circuits – to a conservative majority.

“With pro-life judges on federal benches, state laws protecting the unborn will have a much better chance of being enacted without needless delay,” Father Pavone said. “Very simply, this means lives will be saved.”

Lo and behold, they were right. Now the 9th Circuit has gone from one of the most overturned appeals courts in the country because of its left-wing dominance to upholding the pro-life rule issued by President Trump that allowed DE funding Planned Parenthood under the title 10 family planning program.

Yesterday, the federal appeals court issued a 7-4 ruling upholding enforcement of a pro-life rule instituted by President Donald Trump protecting Americans from having to fund the Planned Parenthood abortion business. The rule shut down one of the many avenues for federal taxpayer funds that Planned Parenthood has accessed over the years.

A three-judge motions panel lifted injunctions against the rule in June, saying the HHS would suffer irreparable harm if prevented from enforcing the rule until the appeal was resolved. The full Ninth Circuit agreed to take another look at the issue, but refused to stop the HHS from enforcing the rule in the interim.

How could that Appeals Court put out a 7-4 pro-life decision?

Well, a report on the decision noted that “President Trump appointees have started to tilt the balance.”
