An Indiana man who was convicted of murdering his pregnant girlfriend after she refused to have an abortion may not have to serve life in prison.
WSBT 22 reports Robert Leamon, 42, of Niles, Indiana, will be re-sentenced after his original sentence of life without parole was thrown out in court last week.
Leamon was convicted of murdering 15-year-old Rebecca Stowe in 1993 and then hiding her body. Stowe was pregnant with their unborn child at the time; Leamon reportedly wanted her to have an abortion, but she refused. He was 16 at the time, according to the report.
Stowe’s body was not found until two years later. Eventually, Leamon was convicted of murder and sentenced to life in prison without parole.
However, he may receive a more lenient sentence because of a 2012 U.S. Supreme Court ruling involving mandatory life sentences and convicted minors, Leader Publications reports. So far, Leamon has spent about 22 years in prison; he could become eligible for parole in a few years because of the recently ruling, according to the report.
In July, he apologized to Stowe’s family for the first time. According to the local news, his lawyers said he has changed his life around, taking classes, working and striving to be a better person.
But others questioned his sincerity, and Stowe’s family said they do not think he should be released on parole.
“Rob knew what he was doing he premeditated us the whole thing,” Stowe’s sister Cindy Slates told WSBT. “It’s not right. It’s not fair.”
