Jury Forces David Daleiden to Pay Planned Parenthood $870,000 for Exposing Its Aborted Baby Part Sales

A California jury has decided that pro-life advocate David Daleiden, and his pro-life colleagues, has caused substantial harm to the Planned Parenthood abortion business as a result of his organization’s undercover reporting and exposing of its potentially illegal sales of aborted baby parts nationwide.

Attorneys for Daleiden, Sandra Merritt and board members of Center for Medical Progress, the group that oversaw the undercover investigation, are expected to appeal the verdict.

Planned Parenthood filed the lawsuit accusing them of more than a dozen crimes, including trespassing, breach of confidentiality, wiretapping and conspiracy. The trial is separate from a criminal case against Daleiden and Merritt launched by former California Attorney General Kamala Harris.

The jury will force Daleiden to pay $870,000 to the abortion corporation in punitive damages for supposedly harming the abortion giant y attending its conferences and events and going on-site to Planned Parenthood abortion centers to record videos exposing the practice.

Daleiden told LifeNews.com that “justice was not done today.”

“While top Planned Parenthood witnesses spent six weeks testifying under oath that the undercover videos are true and Planned Parenthood sold fetal organs on a quid pro quo basis, a biased judge with close Planned Parenthood ties spent six weeks trying to influence the jury with pre-determined rulings and suppressed the video evidence, all in order to rubber-stamp Planned Parenthood’s lawsuit attack on the First Amendment,” he said.

“This is a dangerous precedent for citizen journalism and First Amendment civil rights across the country, sending a message that speaking truth and facts to criticize the powerful is no longer protected by our institutions,” Daleiden continued.

The jury’s verdict came after a biased judge with ties to Planned Parenthood told a the panelists that David Daleiden is guilty of trespassing.

The statement from Judge William Orrick came at the conclusion of a month-long trial against Daleiden, Sandra Merritt and others with the Center for Medical Progress who helped to release undercover videos of Planned Parenthood allegedly selling aborted baby body parts for profit.

Before the jury deliberated, Orrick gave them instructions about how to make their decision, including his decision that Daleiden is guilty.

“I have already determined that these defendants trespassed at each of these locations. Because I determined that these defendants trespassed, the law assumes that Planned Parenthood has been harmed and is entitled to an award of nominal damages such as one dollar for each trespass,” he told the jury.

Orrick said the Center for Medical Progress investigators “trespassed at the 2014 Forum in Miami, Florida; at the 2015 MeDC meeting in Orlando, Florida; and the 2015 National Conference in Washington, D.C.” as well as at the Planned Parenthood Rocky Mountain Center in Colorado and a Planned Parenthood Center in Texas.

Planned Parenthood told the jury that Daleiden and CMP harmed its abortion trade:

Planned Parenthood lawyers denounced Daleiden’s and Merritt’s beliefs about crimes being committed by abortion doctors as a preposterous pretext to disguise their true mission to destroy Planned Parenthood, thus establishing the requisite malice, oppression, and fraud for the jury to award punitive damages.

The organization’s lawyers claim the release of the videos, roughly one per week, were part of a sophisticated scheme to smear the organization and strip it of federal funding.

“The defendants’ plan here was not to find crimes, and it was not about journalism. It was about using any means, including illegal means, to destroy Planned Parenthood,” Planned Parenthood attorney Rhonda Trotter told the jury.

But attorneys for Daleiden and CMP repeatedly caught Planned Parenthood official lying on the stand and agreeing that what Daleiden presented in the undercover videos is accurate.

Leading pro-life advocates told LifeNews.com the verdict is a miscarriage of justice.

Students for Life of America President Kristan Hawkins told LifeNews: “This is a case of shooting the proverbial messenger who had the courage to document the business model of the nation’s number one abortion vendor. It was clear during the hearing that Planned Parenthood did harvest and sell infant body parts. What a miscarriage of justice to punish those who documented the disgusting practices. This is the end of undercover journalism, which ironic timing given all the attention to whistle blowers these days.”

The investigative team’s lawyers repeatedly have criticized how Orrick handled the case, including refusing to allow key experts to testify and to allow the jury to watch some of the undercover footage obtained by Daleiden and Merritt.

Orrick has close ties to the Planned Parenthood abortion chain, but he refused to recuse himself from the case. Prior to becoming a judge, Orrick served on the board of a San Francisco-area family resource center that shares space and helps run a Planned Parenthood facility that refers for abortions.

The undercover investigation exposed numerous atrocities inside Planned Parenthood abortion facilities across the U.S. Its findings prompted investigations by the U.S. House and Senate, as well as a number of states.

Not only did the Center for Medical Progress investigation raise concerns about potentially illegal sales of human body parts, but it also uncovered evidence of abortionists allegedly putting women’s lives at greater risk by altering abortion procedures to better harvest aborted baby parts. The investigators also found evidence of possible patient privacy violations.

Daleiden and his fellow investigators contend that they did not do anything wrong; they are undercover journalists who worked to expose the unethical and potentially illegal harvesting and sales of aborted baby body parts by Planned Parenthood, the nation’s largest abortion provider.

Peter Breen, Daleiden’s lawyer, said their goal was to inform the public of potential wrong-doing within the abortion industry. Planned Parenthood is a billion-dollar “nonprofit” that does more abortions than any other group in America and has massive political power, dumping tens of millions of dollars into elections each year.

“This case is about the steps it took for private citizen investigators to cut through a curtain of silence and concealment,” Breen said in his closing statement. “They didn’t do it for profit or for personal gain. They did it for the paramount public purpose of letting Americans know and law enforcers investigate whether and to what extent our laws may have been violated.”

Earlier in the trial, Orrick allowed the jury to see an ABC News 20/20 investigation from 2000 that sparked Daleiden’s own investigation. The mainstream news outlet found similar evidence of abortionists selling aborted baby body parts for a profit, in violation of the law.

At another point during the trial, a Planned Parenthood witness admitted that some of the security “threats” that they blame on Daleiden’s exposé were not actual threats. Instead, they were letters from people saying they were praying for abortion clinic staff. Still other security incidents were completely unrelated to the undercover investigation.

Daleiden and Merritt believe their prosecution is politically motivated by politicians like California Attorney General Xavier Becerra and Kamala Harris, who received huge campaign donations from the abortion industry. No other journalists have been prosecuted for similar undercover investigations under California law, they contend.

The committees concluded by recommending that the Department of Justice investigate Planned Parenthood. Both said they found strong evidence that the abortion chain broke the law. The Department of Justice is investigating.

Planned Parenthood repeatedly has denied all allegations of wrong-doing, and many news outlets now parrot its talking points that the undercover videos were deceptively edited or debunked, even though that is not true. An independent forensics investigation verified that the videos were authentic.

Some undercover videos show how Planned Parenthood employees callously and flippantly negotiated the price of tiny baby hearts, lungs, livers and brains. Other evidence indicates the abortion giant may have broken HIPAA patient privacy laws.

The expose videos catching Planned Parenthood officials selling the body parts of aborted babies have shocked the nation. Here is a list of all 14:

  • In the first video: Dr. Deborah Nucatola of Planned Parenthood commented on baby-crushing: “We’ve been very good at getting heart, lung, liver, because we know that, so I’m not gonna crush that part, I’m gonna basically crush below, I’m gonna crush above, and I’m gonna see if I can get it all intact.”
  • In the second video: Planned Parenthood’s Dr. Mary Gatter joked, “I want a Lamborghini” as she negotiated the best price for baby parts.
  • In the third video: Holly O’Donnell, a former Stem Express employee who worked inside a Planned Parenthood clinic, detailed first-hand the unspeakable atrocities and how she fainted in horror over handling baby legs.
  • In the fourth video: Planned Parenthood’s Dr. Savita Ginde stated, “We don’t want to do just a flat-fee (per baby) of like, $200. A per-item thing works a little better, just because we can see how much we can get out of it.” She also laughed while looking at a plate of fetal kidneys that were “good to go.”
  • In the fifth video: Melissa Farrell of Planned Parenthood-Gulf Coast in Houston boasted of Planned Parenthood’s skill in obtaining “intact fetal cadavers” and how her “research” department “contributes so much to the bottom line of our organization here, you know we’re one of the largest affiliates, our Research Department is the largest in the United States.”
  • In the sixth video: Holly O’Donnell described technicians taking fetal parts without patient consent: “There were times when they would just take what they wanted. And these mothers don’t know. And there’s no way they would know.”
  • In the seventh and perhaps most disturbing video: Holly O’Donnell described the harvesting, or “procurement,” of organs from a nearly intact late-term fetus aborted at Planned Parenthood Mar Monte’s Alameda clinic in San Jose, CA. “‘You want to see something kind of cool,’” O’Donnell says her supervisor asked her. “And she just taps the heart, and it starts beating. And I’m sitting here and I’m looking at this fetus, and its heart is beating, and I don’t know what to think.”
  • In the eighth video: StemExpress CEO Cate Dyer admits Planned Parenthood sells “a lot of” fully intact aborted babies.
  • The ninth video: catches a Planned Parenthood medical director discussing how the abortion company sells fully intact aborted babies — including one who “just fell out” of the womb.
  • The 10th video: catches the nation’s biggest abortion business selling specific body parts — including the heart, eyes and “gonads” of unborn babies. The video also shows the shocking ways in which Planned Parenthood officials admit that they are breaking federal law by selling aborted baby body parts for profit.
  • Unreleased Videos: Unreleased videos from CMP show Deb Vanderhei of Planned Parenthood caught on tape talking about how Planned Parenthood abortion business affiliates may “want to increase revenue [from selling baby parts] but we can’t stop them…” Another video has a woman talking about the “financial incentives” of selling aborted baby body parts.
  • The 11th video: catches a Texas Planned Parenthood abortionist planning to sell the intact heads of aborted babies for research. Amna Dermish is caught on tape describing an illegal partial-birth abortion procedure to terminate living, late-term unborn babies which she hopes will yield intact fetal heads for brain harvesting.
  • The 12th video in the series shows new footage of Jennefer Russo, medical director at Planned Parenthood in Orange County, California, describing to undercover investigators how her abortion business tries to harvest intact aborted babies’ bodies for a local for-profit biotech company and changes the abortion procedure to do so.
  • The 13th video: exposes a Planned Parenthood medical director admitting that babies born alive after abortion are sometimes killed.
