A new poll released today by Susan B. Anthony List (SBA List) finds that, of those with an opinion, 58 percent of Americans want to see abortion policy decided by the people through their elected representatives rather than by the Supreme Court (22 percent were unsure, 45 percent said their elected officials, 33 percent said Supreme Court).

This position is even stronger among voters in 2018 battleground states whose senators have a key stake in the nomination of Judge Brett Kavanaugh to serve on the Supreme Court:

  • 54% of Florida voters want abortion policy decided by the people through the legislature.
  • 65% of Indiana voters want abortion policy decided by the people through the legislature.
  • 57% of Missouri voters want abortion policy decided by the people through the legislature.
  • 67% of North Dakota voters want abortion policy decided by the people through the legislature.
  • 57% of West Virginia voters want abortion policy decided by the people through the legislature.

Additionally, of those with an opinion, 58 percent of Americans think President Trump’s nominee, Judge Brett Kavanaugh should be confirmed to the Supreme Court (30 percent were unsure, 40 percent in support, 29 percent opposed). Support for confirmation is even stronger among voters in 2018 Senate battleground states:

  • 56% of Florida voters want Nelson to confirm the nominee.
  • 56% of Indiana voters want Donnelly to confirm the nominee.
  • 57% of Missouri voters want McCaskill to confirm the nominee.
  • 68% of North Dakota voters want Heitkamp to confirm the nominee.
  • 59% of West Virginia voters want Manchin to confirm the nominee.

McLaughlin & Associates conducted the survey of 1,000 likely general election voters nationwide between July 20–24, 2018. All interviews were conducted online; survey invitations were distributed randomly within predetermined geographic units. These units were structured to correlate with actual voter turnout in a nationwide general election. This poll of 1,000 likely general election voters has an accuracy of +/- 3.1% at a 95% confidence interval.

“Americans agree it’s time to re-enfranchise the people and their representatives to legislate on abortion. For decades, activist courts have seized this power for themselves, imposing a radical agenda from the top down,” said Susan B. Anthony List President Marjorie Dannenfelser. “Voters also agree Judge Brett Kavanaugh is a highly qualified nominee who deserves to be swiftly confirmed to the Supreme Court. In particular, battleground state voters who elected President Trump by overwhelming margins trusted him to nominate only originalist judges who will respect and uphold the Constitution, a key promise fulfilled in Judge Kavanaugh.”

Activists nationwide are mobilizing online at prolifecourt.com to send messages to their U.S. senators. The campaign, coordinated by SBA List, includes email and phone call campaigns to offices, in-state events targeting key senators, a digital advertising campaign, radio and more.

SBA List’s field team of nearly 500 pro-life canvassers has visited more than 1.1 million homes in the battleground states of Indiana, Ohio, Florida, and Missouri and has expanded to North Dakota, West Virginia, and Montana as part of an historic effort to educate and mobilize voters for the 2018 midterm election. SBA List canvassers are on track to reach two million homes by Election Day.
