Bail has been denied for a mom who gave birth to a baby in a toilet and later threw the child in the dumpster. 27-year-old Shavaughn Robinson of Richmond, Virginia was indicted on one count of first-degree murder after the baby died.

The child’s body was found May 28 in a plastic trash bag in a Dumpster behind the Lee Medical Building on Monument Avenue in the Fan District. Authorities say Robinson gave birth to the child in a bathroom inside the building, where the mother worked, on the afternoon of May 28. A janitor found the child that evening in the trash bin in an alley behind the building.

Relatives of Robinson said they had no idea she was pregnant until news spread that the dead child had been found. Robinson arrested last week on a felony charge of concealing a body and had been held without bond on that charge.

Now, bail has been denied:

A Richmond Circuit Court judge reversed his own decision Monday and denied bail for a woman accused of giving birth in an office building and discarding the infant in a dumpster, where it was found dead.

Judge Clarence N. Jenkins Jr. ruled Monday that attorneys for Shavaughn Robinson had failed to overcome the legal presumption against bail for a defendant facing a charge of first-degree murder.

The about-face ruling came after Jenkins granted Robinson $25,000 bail at a hearing Friday. On that day, prosecutors put Jenkins on notice that they planned to appeal his decision, and they also filed a motion asking him to reconsider his bail ruling.

Robinson was kept in custody until the matter could be taken up again at Monday’s hearing. Prosecutors noted that Jenkins had refused to grant Robinson bail at a hearing in June.

This incident follows one in Pennsylvania. A teenage girl from Pennsylvania who gave birth in her high school bathroom to a baby who was approximately 27-29 weeks old and tried to flush it down the toiler has been released.

Cherlie LaFleur, a 19-year-old McCaskey East High School student, initially tried to flush the baby’s body down the toilet and, when that didn’t work, she placed the baby in the trash can and left.

She was charged with concealing the death of a child but a news report reveals she has been released.
