Clearwater, FL (LifeNews.com) — The parents of Terri Schiavo won a legal victory on Friday when Circuit Court Judge George Greer ruled in favor of Bob and Mary Schindler’s right to visit their daughter.
The Schindlers had only seen their daughter twice recently after Terri’s estranged husband Michael prevented them for nearly two months from visiting her. Michael and his attorneys claimed the Schindlers were responsible for mysterious "puncture marks" that appeared on Terri’s arms on March 29.
However, the Clearwater police department cleared the Schindlers of any wrongdoing and said the marks were likely caused by moving Terri in association with feeding her through a gastric tube.
Judge Greer cited the police report as the reason for restoring the Schindlers’ visitation rights.
"While the police were unable to determine with precision what did in fact occur … they clearly found no evidence of anything approaching criminal conduct," Judge Greer wrote in his 5-page opinion. "To say this was a very thorough, complete competent investigation would almost be an understatement."
Under Florida Statute 744.3215, paragraph (M), Terri retains the right "to receive visitors and communicate with others."
"This is a retained right that no guardian may take away without prior court approval. It was appropriate and necessary for the court to restore this retained right to Terri in light of the fact that no evidence exists to warrant its restriction," the Terri Schindler-Schiavo Foundation said in a statement following the decision.
George Felos, the euthanasia advocate who is Michael’s lead attorney, previously accused the Schindlers of attempting to inject Terri with an unknown drug.
Despite the police report, Michael, who is living with another woman and has already had two children with her, continued to deny Bob and Mary’s requests to see their daughter.
