Trump Nominates Hobby Lobby Attorney Who Fought Obama Abortion Mandate for Appeals Court

Kyle Duncan, President Donald Trump’s nominee for the Fifth Circuit Court of Appeals, is receiving strong support from national pro-life groups.

Notably, Duncan, a lawyer from Louisiana, represented Hobby Lobby at the U.S. Supreme Court when the Obama administration tried to force the Christian business owners to cover drugs that may cause abortions in their employee health plans.

Tony Perkins, president of the Family Research Council, praised Duncan as an experienced litigator and urged the U.S. Senate to confirm him.

I’ve known Kyle Duncan for years — going back to my time in state government in Louisiana,” Perkins said. “Kyle is an experienced litigator — arguing cases throughout the country including at the appellate and Supreme Court levels. Apart from being well-qualified, I’m certain he’ll adhere to the Constitution.”

Pro-life groups Americans United for Life, Susan B. Anthony List and Concerned Women for America likewise urged the Senate to approve Duncan.

Anthony List President Marjorie Dannenfelser. “We are so thankful to President Trump for nominating him and urge the Senate to confirm him without delay.”

Sancha Smith, Louisiana state leader for Concerned Women for America, also urged his swift confirmation.

Kyle Duncan is a Louisiana success story,” Smith said. “He is ready and willing to serve the American people on the Fifth Circuit Court of Appeals. He, his wife and four children, and his fellow nominees should not be forced to languish in political limbo for months, or even years, because of ultra-partisan delay tactics employed by Senate Democrats. It’s time for all our Senators to do their job, get moving, and confirm nominees like Kyle Duncan as soon as possible.”

Deanna Wallace, spokeswoman for Americans United for Life, said she personally has watched Duncan in the courtroom. She described him as an experienced, scholarly man who respects the Constitution.

I urge the Senate to act swiftly to consider and confirm him to serve on the Fifth Circuit Court of Appeals,” Wallace said.

Patrick D. Purtill of the Faith and Freedom Coalition said he worked with Duncan while representing Hobby Lobby and found him to be an excellent litigator.

He is one of the most objective, smart and diligent attorneys I have ever worked with. Louisiana and the whole country would be lucky to have him as a judge on the Fifth Circuit,” Purtill said.

Judicial Crisis Network also is spending six figures on ads supporting Duncan.   

Duncan’s nomination comes at a time when the abortion industry is trying to push its radical agenda through the courts. Abortion activists largely have failed to convince voters to support their radical abortion agenda. Voter-elected state legislators have passed a record number of pro-life laws in the past decade; however, it has become commonplace for the abortion industry to challenge them.

The abortion industry received a lot of help from pro-abortion President Barack Obama who appointed 327 judges during his two terms. Pro-life advocates hope Trump, who promised to be a pro-life president, will appoint pro-life judges who will uphold protections for unborn babies.

Earlier this year, Trump nominated new Justice Neil Gorsuch to the U.S. Supreme Court, a move widely praised by pro-life advocates.
