Further proving that opposition to the Obama administration’s HHS mandate is not limited to Catholic groups, two Baptist-affiliated colleges filed their own lawsuit today against the HHS mandate that promotes abortion.
Today, East Texas Baptist University (ETBU) and Houston Baptist University (HBU) filed a lawsuit in the U.S. District Court for the Southern District of Texas, asking the court for relief from the Department of Health and Human Services’ “preventative services” mandate, which forces the Christian Universities to violate their deeply held religious beliefs or pay severe fines.
“Baptists in America, by virtue of their history, are particularly sensitive to coercive government actions that infringe on religious liberty,” says Eric Rassbach, Deputy General Counsel for The Becket Fund for Religious Liberty, which filed suit this morning on behalf of the two universities.
“America’s first Baptist leader, Roger Williams, had to flee Massachusetts and found a colony in Providence, Rhode Island, because his religious beliefs were not tolerated by the laws of Massachusetts. We shouldn’t have to fight for that same right today,” Rassbach added.
East Texas Baptist University and Houston Baptist University’s religious convictions prevent them from providing their employees with access to abortion-causing drugs. The Universities’ lawsuit aims to preserve their religious liberty and the right to carry out their missions free from government coercion.
“Baptists have always advocated religious liberty, and religious liberty is what is at stake in this situation,” says Dr. Samuel Oliver, President, East Texas Baptist University. “As the famous Baptist preacher, George W. Truett once remarked, ‘A Baptist would rise at midnight to plead for absolute religious liberty for his Catholic neighbor, and for his Jewish neighbor, and for everybody else.’ We are rising today to ensure that religious liberty, the first freedom guaranteed in the First Amendment of the United States Constitution, is protected and preserved.”

The two Universities face fines of over $10 million per year, per institution, if they do not comply with the HHS mandate, the Becket Fund said.
“While we are always reluctant to enter into lawsuits, the government has given us no choice,” says Dr. Robert Sloan, President, Houston Baptist University. “Either we violate our conscience or give in to the administration’s heavy-handed attack upon our religious freedom. We will not comply with this unconstitutional mandate, and we plead with our government to respect the liberties given by God and enunciated in the Bill of Rights.”
There are now 33 separate lawsuits challenging the HHS mandate, which is a regulation under the Affordable Care Act (aka “Obamacare”). The Becket Fund is leading the charge along with other pro-life legal groups like the ACLJ and Alliance Defending Freedom. Becket also represents Hobby Lobby Stores, Inc., Wheaton College, Belmont Abbey College, Colorado Christian University, the Eternal Word Television Network, and Ave Maria University.
A new poll shows that, by a 20-percentage point margin, Americans oppose the HHS mandate the Obama administration put in place that requires religious employers to pay for abortion-causing drugs for their employees.
